PRIVACY AND CONSENT NOTICE

YOUR PERSONAL INFORMATION - GENERAL DATA PROTECTION REGULATION (GDPR)

Sangi Anantha is committed to ensuring that your privacy is protected. She will only use the information that she collects about you lawfully (in accordance with the Data Protection Act May 2018).

This notice describes how your personal data is collected, used, retained, shared and safeguarded.

It sets out your individual rights and the therapist; Sangi Anantha’s rights who is also the Data Controller. (A Data controller determines the purposes and means of processing personal data).

What is personal data?
The GDPR applies to ‘personal data’ meaning any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier.

Personal Data you may volunteer to make contact and arrange consultation, assessment and treatment:-

If you contact me by phone call, email or text or written correspondence requesting information or contact from me, you are volunteering consent to be contacted via your personal preference of contact which may include for e.g. your name, address, email address and telephone numbers as you choose.

Where you disclose the personal information of another by any method of communication including phone, email, text or written correspondence you may only do this if you are entitled to do so for e.g. in the case of seeking treatment as a parent/legal guardian of a minor.

Special Category Data is a category of personal data Sangi Anantha may process with your consent with a lawful basis:-

If you decide to consult Sangi Anantha regarding your health, health information (special category of personal data) as well as your personal data which may include full name, address, email address and telephone numbers is collected for consultation notes/records of consultation/assessment and treatment. This is classed as a “legitimate interest” in providing safe and effective consultation, assessment and treatment fulfilling her role as a professional complementary health therapist.

These client medical health records and consultation notes are required for therapist professional therapy insurance which stipulates “take and retain client records for at least 7 years following the last occasion on which treatment was given. In the case of minors, advisable records should be kept at least 7 years after they reach age of maturity at 18” (Zurich insurance). Accurate and up to date medical records are an insurance requirement for all professional therapists insured in professional practice. The records are required to provide safe, effective consultation, assessment and treatment ongoing from the first consultation. Your special category personal data and identifying personal data is held confidentially and will not be disclosed to a third party without your consent unless required for legal process. This could include if Sangi Anantha is subject to a court order, a medical doctor or police need the information to protect your life or another person’s life, for safeguarding a child or vulnerable adult or for a regulatory body or professional insurer in the event of a compliance or insurance claim.

As a prospective or current client looking to utilise Sangi Anantha’s professional complementary health services, if the collection and recording of the aforementioned data is unacceptable to you, please note you will not be eligible for consultation, assessment or treatment. This is as informed consent which is a legal requirement to treatment includes the therapist, Sangi Anantha, helping you decide by utilising your health information if the treatment she can offer you is relevant and appropriate, safe and effective for you.

Protecting your personal data
Sangi Anantha is committed to ensuring that your personal data is secure. In order to prevent unauthorised access or disclosure, she has put in place appropriate technical, physical and managerial procedures to safeguard and secure the information collected, held and processed.

Your special category personal data and identifying personal data is held confidentially and will not be disclosed to a third party without your consent unless required for legal process.

If you contact Sangi Anantha regarding in person consultation, assessment or treatment but this does get fulfilled, your personal data will be automatically destroyed to protect your privacy.


Your Rights

GDPR gives you the following rights under Data Protection Act May 25th 2018:-

The right to be informed about your personal data being processed:- To know how your information will be held and used (this notice).

The right of access
To see your therapist’s records of your personal information, so you know what is held about you and can verify it.

The right to object to the processing of your personal data
To be able to tell your therapist you don’t want them to use certain parts of your information, or only to use it for certain purposes.

The right to restrict processing of personal data
You have the right to request limits on how your therapist uses your personal information.

The right to rectification
To tell your therapist to make changes to your personal information if it is incorrect or incomplete.

The right to erasure (also called “the right to be forgotten”)
For you to request your therapist to erase any information they hold about you.

The right to data portability
Under certain circumstances you can request a copy of personal information held electronically so you can reuse it in other systems.

The right to lodge a complaint with the Information Commissioner’s Office
To be able to complain to the ICO if you feel your details are not correct, if they are not being used in a way that you have given permission for, or if they are being stored when they don’t have to be.

Therapist's Rights

PLEASE NOTE: You can amend/rectify any information, the therapist, Sangi Anantha holds about you and when this occurs, your signature and date will be added to ensure accuracy and consent to your notes. Due to the need for medical notes/records for insurance purposes, you may not be allowed to erase these notes before 7 years past the final treatment session.

If you don’t agree to your therapist, Sangi Anantha keeping records of information about you and your consultations, assessments and treatments, or if you don’t allow her to use the information in the way she needs to provide health services, the therapist, Sangi Anantha may not be able to offer consultation, assessment or treatment.

Your therapist, Sangi Anantha can move records between computers and IT systems, as long as your details are protected from being seen by others without your permission.

All new clients will be required to sign a copy of the Privacy and consent and consent to treatment documents. All personal data received from non-clients via the website will also adhere to these requirements. For further information on this please email: sangi_anantha@hotmail.com.

Third party sharing of data
Sangi Anantha will not distribute or lease your personal information to third parties unless she has your permission or is required by law. She may use your personal information to send you promotional information about third parties which she thinks you may find interesting if you tell her that you wish this to happen.

Links to third party websites
Sangi Anantha will never share your data with third parties. Sangi Anantha’s professional therapy website contains hyperlinks to websites operated and owned by third parties. These third party websites have their own privacy and cookie policies. Sangi Anantha does not accept any responsibility or liability for the privacy practices of such third party websites and your use of such websites is at your own risk.

Technology including Cookies and Google Analytics may be used to track the patterns of behaviour of visitors to this website. This can include using a "cookie" which would be stored on your browser.
